The Australian Whale Sanctuary was established in 2000, under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC). This sanctuary comprises the waters of Australia’s exclusive economic zone (EEZ), including the EEZ adjacent to the Australian Antarctic Territory.

Section 229 of the EPBC states that it is an offence to take an action that results in the death or injury of a cetacean in the Australian Whale Sanctuary and penalties can include up to 2 years imprisonment.
